Sick Leave: Importance and Regulations in the Workplace

sick leave importance and regulations in the workplace

Sick leave is paid time off an employee takes when illness or injury stops them from working. In India there's no single national number: state Shops and Establishments Acts usually set somewhere between 7 and 12 days a year, and employees covered by ESI can also claim a sickness benefit of 70% of wages for up to 91 days. Most companies write sick leave into their leave policy, with rules on notice, medical certificates, carry-forward and how it interacts with casual leave.

The rules on paper are the easy part. The hard part is the 7.45am message that says 'not well today', and the manager who has to decide whether it's genuine, whether it needs a certificate and whether it'll turn into a pay deduction. Meena runs a school office in Pune with 60 teaching and support staff. In a flu fortnight last winter she had nine people off at once, three different interpretations of the certificate rule among department heads, and two teachers who found loss of pay on their payslips for days they'd reported sick. None of that needed to happen. A clear sick leave process, applied the same way by every manager, takes most of that guesswork away.

Why Sick Leave Matters for Employers Too

It's tempting to see paid sick days as a cost. The numbers usually say otherwise. People who come in ill work slowly, make mistakes and pass infections on, so one lost day becomes five across a team. Staff who can't afford to be sick also tend to hide burnout until it becomes a resignation. A sensible allowance, used honestly, is cheaper than the alternatives, and it signals that the company treats people as adults.

Sick Leave Rules in India: What the Law Requires

The entitlement comes mainly from state law. Each state's Shops and Establishments Act sets its own sick and casual leave for shops, offices and commercial establishments, typically between 7 and 12 days of sick leave a year, sometimes combined with casual leave. Factories follow their state's rules alongside the Factories Act, and many employers simply offer more than the minimum.

ESI is the other half. Employees earning up to ₹21,000 a month are covered by the ESI scheme, and when a doctor certifies them unfit, they can claim a cash sickness benefit of 70% of average daily wages for up to 91 days a year, paid by ESIC rather than the employer. Our guide to ESIC meaning, benefits and contributions explains who qualifies.

Writing a Sick Leave Policy That's Fair and Clear

A usable policy answers six questions. How many days a year, and are they credited upfront or monthly? Who must be told, and by when? After how many consecutive days is a medical certificate needed; two or three is common? Can unused days carry forward, and up to what cap? Can sick leave be used for a child's or parent's illness? And what happens when the balance runs out: earned leave first, then unpaid leave?

Write the answers down once and apply them the same way across departments. Meena's problem wasn't the allowance; it was three heads of department using three different rules.

Sick Leave, Medical Certificates and Privacy

Ask for evidence only where the policy says so, and only for what you need: that the employee was unfit for work, not the diagnosis. Medical certificates are sensitive personal data. Store them securely, limit who can see them, and never discuss an employee's health with colleagues without consent. A manager who asks a sick employee how they're doing is being kind; one who asks what's wrong with them in front of the team is creating a problem.

Managing Sick Leave in OfficePortal

In OfficePortal's leave management system, sick leave is set up as its own leave type with its own annual allowance, accrual schedule and carry-forward cap. Employees apply from the Android or iOS app the morning they're unwell, managers approve with one tap, and balances update straight away, so nobody has to email HR to ask how many days are left.

Approved sick days show as leave in attendance tracking rather than as an absence, and they flow into cloud-based payroll software, so paid sick leave is never deducted as loss of pay. If the balance runs out, further days are classified as leave without pay automatically. ESI contributions are calculated in the same payroll run. Medical certificates can be filed in the encrypted HR document management vault, where role-based permissions keep them away from anyone who doesn't need to see them. Schools and colleges juggling cover for absent teachers can see how this works on our HR software for education page, and our overview of what a leave management system does covers the wider picture.
